1. What the app is
ViDash AI is a dashcam app. It runs entirely on your phone and has these features:
- video recording;
- detection of vehicles, lanes and speed-limit signs;
- forward-collision, following-distance, lane-departure and over-speed warnings;
- viewing and copying files from a stand-alone dashcam.
How the app handles data is described in the Privacy Policy, which forms part of these terms.
2. Who may use the app
You must be old enough, and have the capacity, to enter into a contract under the law where you live, or have a legal guardian's consent. The app is made for drivers and their passengers, not for children.
3. Your right to use the app
On iPhone, your right to install and use the app, and the limits on that right, are set by Apple's EULA. For the Android version on Google Play, that right is set by Google Play's terms.
4. Open-source components and third-party data
The app contains open-source components, for example under the Apache-2.0 and MIT licences. It also bundles third-party data:
- OpenStreetMap, under ODbL 1.0;
- Mapillary, under CC BY-SA 4.0;
- expressway speed-limit decisions.
Each component is subject to its own licence, which takes precedence over these terms for that component. For example, you may extract and reuse the OpenStreetMap data under the ODbL. The list and the licences are in the app under Settings › Thông tin (Information) › Giấy phép mã nguồn mở (Open-source licences) and Settings › Thông tin › Nguồn dữ liệu & giấy phép (Data sources & licences).
5. Driving safety: the most important part
- The app is only an aid to your own observation. It is not a certified advanced driver-assistance system (ADAS). It does not replace automatic braking, radar, mirrors, or your attention and judgement. You are always responsible for driving safely and obeying traffic law.
- Warnings can come late, be wrong, or not come at all. The app may miss vehicles, people, obstacles, lane markings or signs. This is most likely at night, in rain, against the light, with a dirty windscreen, on roads without markings, or when the phone is hot.
- Distances and time-to-collision are estimates from the camera.
- Speed comes from GPS and may differ from your speedometer.
- Signs and speed limits shown by the app are for reference only. They may come from the camera, from earlier trips or from map data, and may be wrong or out of date. Always follow the actual signs, instructions from traffic officers and the law. We do not guarantee that the app detects every sign or that a speed limit it shows is correct.
- Do not handle the phone while the vehicle is moving. Set the app up before you drive. To change a setting, stop somewhere safe first. Some screens, such as the Pro subscription page, are deliberately hidden while the vehicle is moving.
- Mount the phone securely in a suitable holder. It must not block your view or an airbag. Follow the rules on phone use while driving.
- The phone can get hot, especially in the sun and when charging while recording. When it is too hot, the operating system may slow down or stop the camera. The app may then reduce or pause features and may fail to record.
- The app does not guarantee there will be video of any event. Recording can fail, or video can be lost, for many reasons: full storage, heat, interruption by the operating system, a crash that damages the phone, or turning off the screen or switching apps.
6. Your video and your responsibility
You own the video and photos you record. You are responsible for recording, keeping, using and sharing them lawfully, in particular under:
- the rules on a person's right to their image;
- personal data protection law;
- the rules on audio and video recording.
If you turn on the GPS coordinate stamp, the coordinates appear in any video you share.
We do not see, receive or store your video. We therefore cannot recover lost or deleted video.
7. Pro and subscriptions
7.1 Free and Pro
These features are always free:
- forward-collision and following-distance warnings: on-screen text and colours, and a sound when there is danger;
- the lane-departure warning: on-screen text and colour;
- the distance to the vehicle ahead;
- the "Chỉ cảnh báo" (alerts only) mode, which does not record;
- the external dashcam feature;
- viewing, saving and sharing clips already recorded, also after Pro ends.
These features are in Pro:
- dash-cam recording: video of each drive, event clips, snapshots, and the date, time and speed stamp;
- speed-limit signs on the driving screen, from the camera, from earlier trips and from data; the over-speed warning;
- the following-distance, over-speed and lane-departure alert sounds (the danger sound is always free);
- the alerts-only view during a recording drive: the minimal black screen while the video keeps recording.
The "Xem thử" (try a demo) mode, a sample drive that uses no camera and records nothing, always shows every feature, Pro ones included. The "Chọn gói ViDash AI" (choose your plan) screen puts these two lists side by side; the app shows it once after setup if you do not have Pro, and you can open it again in Settings › Gói Pro › "So sánh Miễn phí và Pro" (compare Free and Pro).
We may change this list. A change will not remove features from a subscription period you have already paid for, until that period ends.
7.2 No in-app free window
The free version does not record video and does not show speed-limit signs, not even for a short time at the start of a drive: these features (and the other Pro features in section 7.1) only work while an active Pro subscription is on. The only trial is the App Store's or Google Play's own introductory offer in section 7.4, where the store still offers it to your account.
7.3 Monthly auto-renewing subscription
- Name: ViDash AI Pro – gói tháng (monthly plan). The period is 1 month.
- Price: 29,000 ₫ per month in Vietnam. The exact price, in your local currency and including taxes as the store calculates them, is shown in the App Store or Google Play, and on the app's subscription screen, before you confirm the purchase. If it differs from the figure above, the store's price applies.
- Payment: charged to your Apple ID or Google Play account when you confirm the purchase or, if you start with a free trial, when the trial ends (section 7.4).
- Auto-renewal: the subscription renews automatically every month at the same price and for the same period, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Managing and cancelling: after purchase, you manage the subscription and turn off auto-renewal in your App Store or Google Play account settings. The app's "Quản lý gói đăng ký" (Manage subscription) button takes you there. See how to cancel. Deleting the app does not cancel the subscription.
- After you cancel: Pro stays available until the end of the period you paid for. The app then returns to the free version: no recording, no on-screen speed-limit signs. Videos and photos already recorded stay on the phone and can still be viewed, saved and shared.
- No cut mid-drive: if the subscription expires while you are driving, Pro stays on until that drive ends.
- Price changes: if the price changes, the App Store or Google Play tells you in advance. Where the law or the store's policy requires it, they ask for your consent to the new price before renewing.
- Free trial: new subscribers can start with a 7-day free trial; see section 7.4.
- Billing problems: if the store cannot charge you, it may retry for a while. You keep Pro during any grace period the store provides.
7.4 7-day Pro free trial
- What it is: an App Store or Google Play introductory offer on the monthly plan in section 7.3: the first 7 days are free, with every Pro feature.
- Who is eligible: new subscribers. On the App Store, an Apple ID that has never received an introductory offer in the ViDash AI Pro subscription group; on Google Play, an account that has never had this subscription. The store decides who is eligible. The "Dùng thử Pro 7 ngày" (try Pro for 7 days) button appears only when the store says you are eligible; otherwise the button is "Đăng ký Pro" (subscribe) and you are charged when you confirm. Each account can use the trial once.
- Starting: you confirm the monthly plan in the App Store or Google Play. You are not charged at that point.
- When the 7 days end: the trial turns into the paid monthly plan, 29,000 ₫ per month (the store's price applies). Your Apple ID or Google Play account is charged when the trial ends and every month after that, unless you cancel at least 24 hours before the trial ends.
- How to cancel: as for the monthly plan, in your App Store or Google Play account settings or through the app's "Quản lý gói đăng ký" (Manage subscription) button. See how to cancel. Depending on the store's rules, Pro may end as soon as you cancel or at the end of the trial.
- Unused trial time: as the store defines it, any unused part of the free trial is forfeited when you buy a paid subscription.
- During the trial: the app treats you as a subscriber, with every Pro feature.
7.5 Refunds
Apple and Google process payments, so refunds follow their policies:
- App Store: request a refund at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
- Google Play: request a refund under Google Play's refund policy.
You can also email us for guidance. If a purchase is refunded, Pro access ends from the next drive.
7.6 Restoring purchases and changing phones
The "Khôi phục giao dịch" (Restore purchases) button gets back a subscription on a new phone, or after reinstalling the app. Use the same Apple ID or Google account that bought it.
The app has no account of its own, so a subscription bought on iPhone does not carry over to Android, or the other way round. Family Sharing does not apply to version 1.0.
8. Updates, changes and discontinuation
We may update the app, its map and sign data, and its AI models to fix bugs, improve accuracy or comply with the law. Updates may change or remove features.
Pro delivers continuing value through these updates. We do not promise a schedule of updates or any particular level of accuracy.
If we stop offering the app or Pro, we will:
- announce it in advance in the app or on this page;
- stop taking new subscriptions;
- let running subscriptions expire without renewing.
9. Intellectual property
The app, its AI models, its interface, and the ViDash AI name and icon belong to us or our licensors. Apart from the right of use described in section 3 and your rights under the open-source licences in section 4, these terms give you no other rights.
These names are trademarks of their respective owners: Apple, App Store, iPhone, Google, Google Play, Android, OpenStreetMap, Mapillary, and the names of dashcam brands.
10. Support and maintenance
We, not Apple or Google, are responsible for supporting and maintaining the app. Contact details are on the Support page.
11. No warranty
To the fullest extent the law allows, the app is provided "as is" and "as available". We do not guarantee that:
- the app will run without interruption or errors;
- it will work on every device;
- it will detect every situation correctly;
- sign and speed data are accurate or current.
These terms do not exclude any right that the Law on Protection of Consumer Rights, or other mandatory law, gives you.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for:
- indirect, incidental or consequential loss;
- accidents, collisions or injuries;
- traffic fines;
- loss of video or data, loss of time, or loss of profit.
This applies to loss arising from using or being unable to use the app, or from relying on any warning, sign or speed limit the app shows.
This limit does not apply to liability that the law does not allow to be limited, such as loss caused by our wilful misconduct.
13. Relationship with Apple's EULA
If you downloaded the app from the App Store, Apple's EULA governs the licence to the app. These terms only supplement Apple's EULA; they do not replace it. If anything here conflicts with Apple's EULA, Apple's EULA prevails.
We, not Apple, are responsible for the app and its content, including its support and maintenance (section 10).
14. Termination
You may stop using and delete the app at any time. A subscription must be cancelled separately in the store; see section 7.3.
Your right to use the app ends under the conditions of Apple's EULA, or of Google Play for the Android version. Sections 4, 6, 9, 11, 12 and 16 survive termination.
15. Changes to these terms
We may change these terms. The new version is published on this page with a new effective date. For important changes, we announce them in the app or in the release notes before they take effect.
Changes to the subscription price always go through the App Store or Google Play process described in section 7.3.
16. Governing law and disputes
In matters not covered by Apple's EULA, these terms are governed by the law of the Socialist Republic of Vietnam. Disputes are first settled by negotiation: contact us at support@banhmiapp.com. If negotiation fails, the dispute goes to the competent People's Court in Vietnam.
If you are a consumer, you keep every dispute-resolution route that the Law on Protection of Consumer Rights gives you. You also keep any mandatory consumer protection of the country where you live.
The Vietnamese version of these terms prevails. This English version is for reference only.
17. Sharing sign data
The app sends our server the speed signs the camera read, with the approximate position of each sign, the direction of travel and the date it was seen. The app never sends video, photos, your route, your vehicle's speed, your name, an account or a device identifier.
- Purpose: better speed-limit data for every user. Signs sent by many people are combined and then added to later updates of the app.
- When it is sent: the app collects the signs on the phone and sends them at most once a day, never while you are driving.
- On and off: when you accept these terms on first launch, sharing is turned on. If you had already declined sharing before, the app keeps that choice. You can turn it off at any time in Settings › Biển báo & tốc độ (Signs & speed) › "Chia sẻ dữ liệu biển báo" (Share sign data), on every plan, free of charge. When you turn it off, the app stops sending and deletes the signs not yet sent from the phone.
- No feature depends on sharing. With sharing off, the app works as before.
Details are in section 6 of the Privacy Policy.
